Question 1 :What is F.I.R.?

Answer 1 : First Information Report (FIR) is a written document prepared by the police, when they receive information about the commission of a cognizable offence. It is a report of information that reaches the police first in point of time and that is why it is called the First Information Report.

सवाल १ .एफ.आई.आर. क्या है ?

उत्तर १ : प्रथम सूचना रिपोर्ट (एफ.आई.आर) पुलिस द्वारा तैयार किया गया एक लिखित दस्तावेज है ,जब उन्हें संज्ञेय अपराध के कमीशन के बारे में जानकारी प्राप्त होती है।  यह सूचना की एक रिपोर्ट है जो पुलिस के पास समय से पहले पहुंचती है और इसीलिए इसे प्रथम सूचना रिपोर्ट कहा जाता है।

Answer 2 : FIR is an important document because it sets the process of criminal justice in motion. It is only after the FIR is registered in the police station that the police take up investigation of the case.

उत्तर २ : एफ.आई.आर एक महत्वपूर्ण दस्तावेज है क्योंकि यह आपराधिक न्याय की प्रक्रिया को गति में सेट करता है।  Police Station में एफ.आई.आर दर्ज होने के बाद ही पुलिस मामले की जांच करती है।

Question 3 : What is the procedure of filing an FIR?

Answer 3 : The procedure of filing an FIR is prescribed in Section 154 of the Criminal Procedure Code, 1973. commission of a cognizable offence is given orally, the police must write it down on paper.

सवाल ३ : एफ.आई.आर दर्ज करने की प्रक्रिया क्या है?

उत्तर ३ : प्राथमिकी दर्ज करने की प्रक्रिया आपराधिक प्रक्रिया संहिता, 1973 की धारा 154 में निर्धारित है। संज्ञेय अपराध का कमीशन मौखिक रूप से दिया जाता है, पुलिस को इसे पेपर पे लिखना होगा।

Answer 4 :

• Anyone who knows about the commission of a cognizable offence can file an FIR at first instant.
• It is not necessary that only the victim of the crime should file an FIR.
• A police officer who comes to know about a cognizable offence can file an FIR himself/herself at a time.

सवाल ४ : कौन एफ.आई.आर दर्ज कर सकता है?

उत्तर ४ : 

• जो कोई संज्ञेय अपराध के आयोग के बारे में जानता है, वह एफ.आई.आर दर्ज कर सकता है।
• यह जरूरी नहीं है कि केवल अपराध का शिकार व्यक्ति ही एफ.आई.आर दर्ज करे।

Question 5 : What to do if the Police refuse to Resister an FIR?

Answer 5 : If you report a crime and the police denies to register an FIR on unreasonable grounds, you can make a complaint to a higher rank officer. If the Police still deny lodging your FIR, you can make a formal complaint to the nearest judicial magistrate, who will direct the police to register the FIR if deemed necessary.

सवाल ५ : अगर एफ.आई.आर दर्ज करने के लिए पुलिस मना कर दे तो क्या करना है?

उत्तर ५ : यदि आप एक अपराध की रिपोर्ट करते हैं और पुलिस अनुचित आधार पर प्राथमिकी दर्ज करने से इनकार करती है, तो आप एक उच्च रैंक के अधिकारी को शिकायत कर सकते हैं।  यदि पुलिस अभी भी आपकी एफ.आई.आर दर्ज करने से इनकार करती है, तो आप निकटतम न्यायिक मजिस्ट्रेट को एक औपचारिक शिकायत कर सकते हैं, जो आवश्यक समझे जाने पर पुलिस को एफ.आई.आर दर्ज करने का निर्देश देगा।
